BOAT & EQUIPMENT RENTAL AGREEMENT
- SECURITY DEPOSIT & PAYMENT
A security deposit of $3,500 is required to reserve the watercraft and is due at the time of booking. The deposit will be refunded within 14 days after the rental ends, provided no damage or charges are incurred. Renter authorizes UAR to charge the credit card on file for any amount exceeding the deposit, including but not limited to repairs, replacement costs, cleaning, fuel, and late fees.
- INSURANCE REQUIREMENT
Renter must provide proof of full coverage insurance for the rental period. This must cover liability, theft, damage, and injury. Failure to provide valid insurance will result in cancellation without refund.
- CONDITION, CLEANLINESS & RETURN
Renter must return the boat and all equipment in the same condition in which it was received. A mandatory cleaning fee of $350 will be charged. Additional charges may apply for excessive dirt, staining, or neglect.
Late returns incur a fee of $100/hour after a 15-minute grace period. Fuel must be returned at the same level or an $8/gallon surcharge applies.
- EQUIPMENT INCLUDED IN RENTAL
The rental includes the AXIS WAKESETTER A22 ski boat, trailer, and the following equipment:

Renter is financially responsible for each item. All lost or damaged items will be replaced at new, factory-direct retail prices.
- TRAILER LIABILITY
Renter is responsible for all trailer-related damages, including curb rash, bent rims, popped tires, broken lights, or connector damage. All damage will be assessed and charged accordingly.
- DAMAGE, THEFT & UNAUTHORIZED USE
Renter accepts full liability for all damage including hull, prop, rudder, shaft, ballast system, electrical systems, and theft. Renter shall not make unauthorized repairs or modifications.
Any tampering with components voids the agreement. Renter is liable for total loss or any stolen part(s). All parts must be replaced using new, OEM equipment. Labor will be billed at $100/hour. Towing assistance billed at $120/hour.
Renter shall be fully liable for any damage or injury resulting from reckless operation, willful misconduct, or gross negligence — including but not limited to speeding, unsafe towing, or allowing unqualified individuals to operate the vessel.
- OPERATIONAL LIMITS
Renter must be at least 25 years of age and operate the vessel in waters at least 5 feet deep. No dry docking or beaching is permitted. Renter must obey all Utah boating laws including:
– Life vests for passengers under 12
– No wake within 150 ft. of another vessel
– No operation while intoxicated or under the influence
Violations will result in immediate contract termination and loss of deposit.
- SAFETY BRIEFING REQUIREMENT
All renters and operators must complete a safety briefing with a UAR staff member. This includes vessel controls, emergency procedures, Utah law compliance, and equipment use.
Failure to complete this voids the agreement.
- GPS TRACKING & MONITORING
Renter consents to the use of GPS tracking for safety, theft prevention, and operational compliance. Data may be used to assess damages or contract breaches.
- NO SUBLEASING OR THIRD PARTY USE
Renter may not sublease, lend, or permit use by any third party not named in this agreement. Violation results in contract termination, full deposit forfeiture, and full liability.
DOCUMENTED INSPECTION REQUIREMENT
Renter and UAR will conduct photo/video inspections at pick-up and return. These images will determine responsibility for damage, condition, or missing equipment.
- MECHANICAL ISSUES & SERVICE
Renter must immediately report any mechanical issues. Renter may not attempt repairs. If UAR staff determines the issue is user-caused, renter will be charged for labor and parts. Flooded engines, clogged props, and low battery issues caused by renter misuse are not refundable.
- RELEASE & INDEMNITY
Renter acknowledges that boating, water sports, and towing involve risk of injury or death. Renter agrees to release and hold harmless Utah Adrenaline Rentals, LLC and all affiliated parties from liability. Renter indemnifies UAR against any third-party claims, injuries, or property damage.
Renter assumes full legal and financial responsibility for all individuals who operate or ride on the watercraft during the rental period, regardless of whether they signed this agreement.
Renter acknowledges they must disclose all known or suspected damage at the time of return. Failure to do so may be considered fraud or misrepresentation.
In the event of fire, full or partial sinkage, or submersion of the watercraft, Renter is responsible for all resulting costs including recovery, environmental remediation, and full replacement if applicable.
Renter acknowledges that the value of the vessel and equipment may exceed $100,000. In the event of total loss or negligence, renter agrees to be fully financially responsible for the full replacement value.
Renter waives any right of subrogation by their insurance carrier against UAR, its owners, and employees.
Renter shall be responsible for any environmental damage, pollution, fuel spills, or violations of DNR, EPA, or waterway authority regulations occurring during the rental period.
Failure to return the equipment within 24 hours of the agreed return time without written extension shall be considered unlawful conversion of property, and may be prosecuted as theft.
- DISPUTE RESOLUTION
Any disputes shall be resolved via binding arbitration in the State of Utah. Renter waives the right to jury trial.
Renter grants UAR permission to use any photos or videos taken during the rental for promotional or marketing purposes, unless otherwise requested in writing.
In the event of legal action, the prevailing party shall be entitled to recover all legal fees, court costs, and reasonable attorney’s fees.
This agreement may be executed in counterparts and signed electronically. Electronic signatures shall be considered valid and binding under Utah law.
Renter agrees that any promotional media, including photos or videos used by UAR for advertising, shall not be considered a warranty, promise, or guarantee of safety, condition, or experience.
This Agreement may not be modified orally. All amendments must be in writing and signed by both parties.
- REFUND POLICY
No refunds are granted due to weather, early return, late arrival, misuse, or renter-induced mechanical failure. UAR reserves the right to refuse service or end rental without refund in the event of contract violation.
Rental proceeds regardless of weather unless UAR, in its sole discretion, deems conditions unsafe. No refunds or rescheduling due to rain, wind, or temperature unless safety is compromised.
- GOVERNING LAW
This Agreement is governed by Utah law. Venue shall lie in the courts of [Your County] County, Utah.
UAR shall not be held liable for delays, cancellations, or inability to deliver equipment due to force majeure events, including but not limited to natural disasters, road closures, or governmental restrictions.
Renter shall not remove the vessel from the State of Utah without prior written consent from UAR. If permitted, Renter agrees this Agreement remains fully enforceable in any jurisdiction where the boat is transported or operated.
This Agreement shall be governed by the laws of the State of Utah. Any legal action may be brought in the courts of Utah or in the jurisdiction where the vessel is located, at UAR’s sole discretion.
Renter agrees to submit to the personal jurisdiction of the State of Utah for any claims arising out of this Agreement and waives any objection to venue.
- REGISTRATION AND TRANSPORT ACKNOWLEDGMENT
Renter shall not attempt to register, re-title, or transfer ownership of the vessel or trailer in any state or jurisdiction. The vessel remains property of UAR at all times.
If the vessel is transported across state lines, Renter is solely responsible for complying with any applicable registration or Aquatic Invasive Species (AIS) inspection requirements in the receiving jurisdiction.
- SPECIAL USE & CONTAMINATION PRECAUTIONS
If Renter operates the vessel on Lake Powell, they must inform UAR at the time of booking. UAR imposes a $500 Lake Powell Usage Fee to offset the mandatory downtime and inspection compliance requirements. Failure to disclose Lake Powell use will result in immediate forfeiture of deposit and additional fines.
Renter is responsible for full compliance with all Utah Aquatic Invasive Species (AIS) regulations after each use of the boat, regardless of location. This includes:
– Removing all drain plugs
– Fully draining all bilges, ballast tanks, and live wells (on both incline and flat ground)
– Stopping at mandatory inspection stations as required
UAR provides a spray bottle filled with state-approved cleaner and microfiber cloths. Renter is required to wipe down the **entire interior and exterior** of the boat after use in any body of water. **Failure to perform this cleaning step will result in a $500 fine.** No exceptions.
Renter agrees to indemnify UAR for any legal action, fines, or enforcement related to noncompliance with decontamination rules, including but not limited to inspections, citations, and impoundments.
- FUEL REQUIREMENTS
Renter agrees to only use 91 octane fuel in the boat. No exceptions. This octane level is required for the boat to operate properly. Using lower octane fuel will result in the following:
– Engine Knock: Lower octane fuel burns too quickly, causing premature combustion that can damage engine components.
– Reduced Performance: The boat may experience slower acceleration, poor fuel economy, and reduced overall power.
– Engine Damage: Prolonged use of incorrect fuel may lead to severe and costly engine damage.
If Renter fails to follow this fuel requirement, they accept 100% financial responsibility for all resulting damage, including the full cost of engine replacement and any related repairs.
